Optima Werkz Reward Programme Terms & Conditions

The Optima Werkz Rewards programme (the “Programme”) and its benefits are offered at the sole discretion of Optima Werkz Pte Ltd and its related corporations (collectively herein as “OW”). OW has the rights to add, change, limit or cancel the Programme terms and conditions (the “T&C”), at any time, with or without notice, even though such changes may affect the value of points already accumulated, the ability to use accumulated points, or the ability to obtain certain rewards.

    1. Eligibility & Enrolment
      1. Participation in the Programme is open to all customers in Singapore who purchased OW’s products and services from 10th May 2019 onwards, with the following exceptions:
        1. Corporate Customers (i.e. Companies & other entities)
        2. Car Dealers
        3. Employees of Optima Werkz and its related corporations
        4. Rental Customers
        5. Motor Claims Customers paying for insurance excess
        6. Any purchase of Insurance or Warranty products
        7. Other special discounts/promotions that are concurrently running, unless otherwise specified for eligibility
        8. Certain transactions are not eligible, OW officer will advise accordingly when such transaction arises.
      2. The Programme has no predetermined termination date and may continue until such time as OW decides to terminate the Programme, at any time, with or without notice. If the Programme is terminated, all unredeemed points shall be forfeited without any obligation or liability, and no award claims shall be honoured after the conclusion of any notice period.
      3. To register as a participant, simply fill in and submit the form containing your relevant particulars. By registering, each participant has read and agreed to be bound by the terms and conditions of this Programme.
      4. OW reserves the right to refuse participation or terminate the participation of any individual without giving a reason.
    2. Points Accumulation, Expiration, & Redemption
      1. Points will only start to accumulate after successful registration.
      2. Except as otherwise restricted herein, all participants enrolled in this Programme will gain points per successfully paid transaction of a minimum of S$30, and in turn accumulate such points to redeem available rewards.
      3. “Paid” means OW has received payment for the products and services purchased by you. Accordingly, if you stop payment on a check, if a check bounces, or if you dispute a credit card bill, you have not “paid”, and you will not earn any points for that transaction.
      4. As of 15 Jul 2019 onwards, for every S$30 spent, a registered participant will earn 1 point in return.
      5. Allow approximately up to 5 working days for your points to be credited.
      6. The accumulation of points does not entitle participants to any vested rights with respect to points, rewards, or program benefits.
      7. Points earned cannot be transferred between registered participants.
      8. OW may, among other things:
        1. Increase or decrease the number of points earned for each purchase, or even the number of points required for a reward.
        2. Withdraw, limit, modify, substitute or cancel any reward.
        3. Restrict the earning of points for products and/or services already on promotion, or otherwise restrict the continued availability of rewards.
        4. Change the Programme benefits, conditions of participation, rules for earning redeeming, retaining or forfeiting points, or rules governing the use of rewards.
      9. All participants are bound by any such changes mentioned in point 2.viii, with or without notice.
      10. In accumulating points, participants may not rely upon the continued availability of any reward. All rewards are subjected to availability as determined by OW.
      11. Each participant is responsible for remaining knowledgeable as to the Programme Terms and Conditions and as to the number of points he/she has accumulated.
      12. If you believe that your account activity statement or points accumulation is inaccurate, please do not hesitate to send an email to feedback@ow.sg or contact our customer service officers.
      13. OW makes no warranties or representations, either expressed or implied, and expressly disclaim all liability (including consequential damages) with respect to type, quality or fitness of goods or services rewarded through the Programme.
      14. By redeeming a reward, the participant releases OW and its affiliates from any and all liability regarding the redemption or use of any reward, or other participation in the Programme.
      15. The Programme rewards or points accumulated cannot be redeemed for cash at any time unless required by law or permitted by OW otherwise.
      16. All interpretations of the Programme Terms and Conditions shall be at the sole discretion of OW.
      17. OW has the absolute and final say in any dispute arising from the Programme that cannot be resolved amicably.
      18. Neither the Programme nor any benefit offered by the Programme creates, constitutes or give rise to any legal or contractual rights by participants against OW.
      19. In case of fraud or abuse involving this Programme, OW will have the rights to take appropriate and/or legal action, including immediate termination of participation from this Programme.
      20. OW and our Programme affiliates are not responsible for:
        1. Loss or misdirection of, or delay in receiving, any participant’s application & correspondences.
        2. Any errors published in relation to the Programme, including, without limitation, any pricing or typographical errors, errors of description, errors regarding participating brands and Programme affiliates, and errors in the crediting or debiting of points from Participants account. We reserve the right to correct, without notice, any errors.
      21. Please notify our Service Advisors or Customer Service Officers in advance when you would like to redeem your points, albeit subjected to availability.
    3. Participant Cancellation
      1. OW reserves the right to cancel any individual’s participation in the Programme and revoke any and all unredeemed rewards points collected by any participants who appears to be using the Programme in a manner inconsistent with the Terms and Conditions or intent of the Programme or any portion of the Programme, and for reasons that include, but are not limited to:
        1. Violation of these Terms & Conditions
        2. Misrepresentation of any information or any misuse of the Programme
        3. Violation of any local law or regulation in connection with the use of the Programme’s rewards
        4. Failure to pay for any outstanding amount owed to OW after the credit period (if any)
        5. Commission of Fraud or abuse involving any portion of this Programme
        6. Action, in any other way, to the detriment of the Programme, OW or its affiliates; or as may be determined by OW in its sole discretion.
      2. Participants who do not earn points in any 12 consecutive months may be removed from the Programme and will forfeit all accumulated points.
      3. Participants may cancel their participation in the Programme at any time by giving written notice to feedback@ow.sg. If you do this, all unredeemed points will be forfeited immediately, and may not be reinstated or transferred.
      4. Redeemed rewards are not exchangeable for other rewards, or refundable, replaceable, or transferable for cash or credit under any circumstances.
    4. Communications
      1. At the end of each month, OW will send you your point balance via email and/or SMS.
      2. As a participant, you will periodically receive emails from OW regarding latest promotions and offers which you could use your points to redeem.
      3. You may opt out of the marketing emails at any time, but operational emails and SMS(s) will still be sent to you as it relates to your participation in this Programme. (i.e. Welcome emails, Monthly points balance email, or other communications that will help us to ensure that your account is monitored and updated).
    5. Limitation of Liability
      1. OW shall not be liable to any person for any action taken or neglected to be taken with respect to the Programme.
      2. The sole remedy available to you in connection with the Programme (whether your claim is based in law or equity) shall be the crediting or re-crediting to your Programme account of OW Rewards points in an amount no greater than the number of rewards points at issue. In no event shall we be responsible or liable for special, consequential, extraordinary or indirect losses or damages, including any lost profits.
      3. If we improperly deny a reward points accrual or a redeemed reward benefit, our liability is limited to the proper posting of points into your account.
      4. Under no circumstances, including, but not limited to, negligence, shall any of OW’s, its affiliates, officers, directors, employees (“released parties”) be liable for any direct, indirect, incidental, special or consequential damages arising out of the Programme or merchandise/services offered through the Programme, even if any or all of the foregoing or any of their authorized representatives have been advised of the possibility of such damages. By participating in the this Programme, each participant hereby releases the released parties from and against any and all claims, damages, losses, liabilities, and other expenses (including, without limitation, attorney’s fees) relating to that participant’s involvement in OW rewards Programme, use of participant’s account balance or rewards, or agreement to these Terms.
    6. Privacy
      1. Your privacy is important to us. Thus, enrolment information collected by us for the Programme is subjected to OW’s privacy policy. Please refer to https://ow.sg/privacy-statements/ for more information.
      2. Your personal data collected for this Programme may be used and disclosed by OW to third parties who are providing products and services as rewards redeemable for this Programme.
    7. Waiver
      1. Failure of OW to insist on strict compliance with any of the terms, covenants, and conditions of this Programme’s Terms and Conditions shall not be deemed a waiver of such terms, covenants, and conditions, or of any similar right or power hereunder at any subsequent time.
    8. Governing Law
      1. The terms and conditions of this Programme and all matters relating to this Programme will be governed in all aspects by the laws of Singapore.
      2. In case any provision in this Programme’s Terms and Conditions is held by a court of competent jurisdiction to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
